1. Who we are

EireMaintenance.ie is the trading name of MB Property Maintenance Ltd. We provide property maintenance, repair, renovation and related services. For the purposes of the General Data Protection Regulation (GDPR) and the Data Protection Act 2018, MB Property Maintenance Ltd is the data controller for the personal data described in this policy.

2. What this policy covers

This policy explains how we collect, use, share, retain and protect personal data when you visit our website, request a quotation, communicate with us, engage us to carry out work, supply goods or services to us, or otherwise deal with our business.

3. Personal data we collect

  • Identity and contact details, such as your name, address, email address and telephone number.
  • Property and job details, such as the work location, access arrangements, measurements, plans, specifications, defects, preferences and information needed to assess or carry out the work.
  • Quotation, contract and account information, including estimates, accepted scope, variations, invoices, payment status and transaction references. We do not normally store full payment-card details.
  • Communications, including emails, calls, text or WhatsApp messages, enquiries, feedback, complaints and instructions.
  • Job records, including site notes and photographs or videos taken for assessment, progress, quality control, certification, warranty, insurance or dispute purposes.
  • Website and device information, such as IP address, browser and device type, pages visited, referral source, approximate location, cookie identifiers and interaction or conversion information.
  • Information supplied by third parties, such as a landlord, property manager, insurer, local authority, main contractor, family member or other authorised representative.

Please do not send us special-category or highly sensitive personal data unless it is genuinely necessary for the service and we have asked for it.

4. How we use your data and our legal bases

Enquiries and quotations: We respond to you, arrange visits and prepare and follow up quotations. Legal basis: steps before a contract and our legitimate interests.

Providing our services: We plan, schedule, carry out, document and complete agreed work and communicate about changes and payment. Legal basis: contract.

Business administration: We maintain customer records and handle invoices, payments, bookkeeping, tax, insurance and audits. Legal basis: contract, legal obligations and legitimate interests.

Safety, quality and claims: We keep necessary site records, job photographs, certifications and records relating to warranties, complaints, debt recovery and legal claims. Legal basis: legal obligations and legitimate interests.

Website operation and security: We deliver the website, prevent misuse, diagnose faults and maintain security. Legal basis: legitimate interests and strictly necessary technologies.

Analytics and advertising: We measure website use and advertising results, including through Google tags where enabled. Legal basis: consent.

Marketing: We send optional news, service updates or offers. Legal basis: consent, or another lawful electronic-marketing basis where applicable.

Where we rely on legitimate interests, those interests are operating and protecting our business, responding to customers, maintaining accurate job records, improving our services and establishing or defending legal claims. We balance those interests against your rights and reasonable expectations.

Where processing is based on consent, you may withdraw consent at any time. Withdrawal does not affect processing already carried out lawfully.

5. If you do not provide information

You are generally free not to provide personal data. However, we may be unable to assess the work, provide an accurate quotation, enter into a contract, attend the property, complete the service or meet legal and safety obligations without the information reasonably required for those purposes.

6. Cookies, Google tags and external links

Our website may use cookies and similar technologies. Strictly necessary technologies may operate without consent where they are required to provide a service you request. Analytics, advertising and conversion-tracking technologies will be used only after you give consent through our cookie settings.

The website currently uses Google Tag Manager and a Google Ads conversion tag. These tools may process identifiers, IP address, device or browser information, referral and interaction data. Google may process data outside the European Economic Area, subject to the safeguards described below.

You can accept, reject or change non-essential cookie choices using the cookie settings link on the website. Your browser also allows you to block or delete cookies, although this may affect some functions. Detailed cookie names, providers, purposes and lifetimes should be shown in the website’s cookie settings.

Our website contains telephone, email and WhatsApp links and may contain links to other websites. If you follow an external link, the other provider’s privacy terms apply. In particular, communications through WhatsApp are also processed by WhatsApp/Meta under its own privacy terms.

7. Who we share personal data with

We may share only the information reasonably necessary with:

  • our employees and authorised workers who need it to manage or carry out the work;
  • subcontractors, specialist trades, suppliers and delivery providers involved in your project;
  • IT, website-hosting, email, cloud-storage, job-management, accounting and communications providers, including services such as ServiceM8, QuickBooks, Google and WhatsApp where used;
  • banks, payment providers, accountants, tax advisers, insurers, auditors and professional advisers;
  • Revenue, local authorities, regulators, courts, law-enforcement bodies or other public bodies where required or permitted by law;
  • a purchaser, adviser or successor if our business or assets are reorganised, financed, sold or transferred, subject to appropriate confidentiality arrangements.

We do not sell or rent your personal data. Where a service provider processes personal data for us, we require appropriate confidentiality, security and data-protection terms. Where independent contractors or authorities determine their own purposes, they are responsible for their own compliance.

8. International transfers

Some technology providers may store or access personal data outside Ireland or the European Economic Area. Where this happens, we use a lawful transfer mechanism, such as an adequacy decision or approved Standard Contractual Clauses, together with additional safeguards where appropriate. You may contact us for information about the relevant safeguard.

9. How long we keep personal data

We keep personal data only for as long as necessary for the purpose collected, including legal, tax, warranty, insurance and claim requirements. Our usual guide is:

Unsuccessful enquiries and quotations: Normally up to 24 months after the last meaningful contact, unless needed for a complaint or claim.

Customer, contract and job records: Normally for the relationship and up to 7 years afterwards, or longer where needed for a warranty, certification, safety issue or legal claim.

Invoices, payments and tax records: At least 6 years after the end of the relevant accounting period, or longer where Revenue rules or an ongoing matter require it.

Job photographs and videos: For as long as reasonably needed for project records, quality, warranty, insurance or claims; then securely deleted or anonymised.

Marketing records: Until consent is withdrawn, you opt out, or the information is no longer useful; suppression records may be kept to respect an opt-out.

Website security logs and consent records: For the period reasonably required for security, troubleshooting and proof of consent, based on the technology used.

10. How we protect your data

We use reasonable technical and organisational safeguards appropriate to the nature of the information and the risks involved. These include access controls, password protection, device and account security, secure backups, staff awareness, careful sharing and deletion or anonymisation when information is no longer needed. No online or electronic system can be guaranteed completely secure.

11. Your data-protection rights

Subject to the GDPR and any applicable exceptions, you may have the right to:

  • ask for access to your personal data and information about how it is used;
  • ask us to correct inaccurate or incomplete personal data;
  • ask us to erase personal data;
  • ask us to restrict how personal data is used;
  • receive certain data in a portable, machine-readable format;
  • object to processing based on legitimate interests and object at any time to direct marketing;
  • withdraw consent at any time where consent is the legal basis;
  • complain to the Data Protection Commission.

We may ask for reasonable proof of identity before releasing or changing information. We normally respond within one month, although the GDPR permits an extension for particularly complex or numerous requests.

You may complain to the Data Protection Commission at www.dataprotection.ie. We would appreciate the opportunity to address your concern first, but this does not limit your right to contact the Commission.

12. Automated decisions

We do not currently use personal data to make decisions based solely on automated processing that produce legal or similarly significant effects.

13. Children

Our website and services are not directed at children. If information about a child is relevant to access, safety or the requested work, it should be provided by a parent, guardian or other authorised adult and limited to what is necessary.

14. Changes to this policy

We may update this policy to reflect changes to our services, technology or legal requirements. The current version will be posted on our website with its effective date. Material changes may also be brought to your attention by another appropriate means.
